MyHyundai and Cl!ck to Buy

1. Applicable Scope.

1.1 These Terms of Use (the "Terms") govern the use of the MyHyundai and the Cl!ck to Buy online platforms and related services (collectively the “Services”) offered by [Company Name, Address…] (referred to as “we”, “us” or “our”) to persons accessing the Services in accordance with the requirements set out in these Terms (referred to as “you” or “Customer”).

2. How to access the Services.

2.1 You can access the Services online on our websites and our app (in case of myHyundai).

2.2 In order to use the Services you are required to:

  1. set-up a Hyundai Account;
  2. read and accept these Terms;
  3. select the myHyundai and/or Cl!ck to Buy Services you wish to use;
  4. read and acknowledge myHyundai Privacy Notice  and the Cl!ck to Buy Privacy Notice;
  5. provide any additional information required by us and/or a Third Party Provider (as defined in section 3.3.) and/or Hyundai Dealer (as defined in section 4.1.) in order to effectively provide you with the Services you have selected. 

2.3 The use of the Services requires internet access or services. These Terms do not cover any such services. Internet services, and their prices, are subject to separate agreement(s) with the provider(s) of such services. 

3. Scope of MyHyundai Services.

3.1 myHyundai is our loyalty platform for all (prospective) Customers who wish or own and use a Hyundai vehicle, which provides access to relevant Hyundai brand related contents, vehicle information, services such as maintenance reminder and vehicle services history, commercial advantages and promotions along the whole customer journey. 

3.2 myHyundai Services shall be considered strictly personal: the promotions and benefits shall be reserved exclusively for the Hyundai vehicle(s) whose vehicle identification number is matched to the registered user. 

3.3 myHyundai Services are made accessible or offered by us or third party providers ("Third Party Providers"). Third Party Providers are referenced to and their Services offered under the sole responsibility of the respective Third Party Service Provider. If you want to access, purchase or subscribe to Third Party Providers Services, you may have to accept specific terms of use of these Third Party Providers that will apply in addition to these Terms. In case there are differences between both sets of terms of use, the specific ones will have priority over these Terms. 

4. Scope of Cl!ck to Buy.

4.1 Cl!ck to Buy is our e-commerce platform that allows Customers purchase Hyundai vehicles from authorized Hyundai dealers (“Hyundai Dealers”).

4.2 Cl!ck to Buy Services are made accessible or offered to (prospective) Customers by us through Hyundai Dealers. We are offering Cl!ck to Buy as a platform for Hyundai Dealers to sell Hyundai Vehicles to Customers. Related Cl!ck to Buy Services such as the provision of quotations or the sales of Hyundai vehicles are offered by Hyundai Dealers under their sole responsibility and separate terms of sale that will be made available to you in the course of the sales process. 

5. Your obligations.

5.1 You may only access the Services if you 

(a) comply with these Terms.

(b) comply with applicable laws and regulations and respect the rights of third parties when using the Services; 

(c) don’t use the Services for unlawful purposes or facilitate that third parties use the Services for unlawful purposes;

(d) don’t do anything which threatens the security of the Services, or could jeopardize or impair our technical infrastructure or that of a third party; 

(e) don’t damage, disable, hack into, or otherwise interfere with the Services, or introduce into the Services to any viruses, "worms", malware, spyware, "Trojans" or any other harmful code or program that could compromise the operation of the Services.

5.2 You are responsible for the choice of your own devices used to access our Services, including the compatibility of such devices in terms of software and technological fitness to receive the Services. You are also responsible for keeping your devices up to date and for installing any updates or new releases when these are made available by us.

6. Our Rights

6.1 We reserve the right to amend these Terms or to modify, discontinue, suspend or replace any Service available or offered at any time and at our discretion. In such case, we will inform you reasonably in advance thereof. 

6.2 We may occasionally suspend or restrict access to the Services in the event of an emergency, for technical problems (repair, maintenance, improvement, etc.), for security reasons and/or for the introduction of changes (new facilities, services, apps, etc.). We will however endeavor to limit the frequency and duration of any suspension or limitation. 

6.3 We may also temporarily or permanently deny you access to the Services in the event of a (suspected) breach of these Terms or misuse of the Services.

7. Intellectual Property 

All Hyundai trademarks displayed in any related websites and apps to the Services are trademarks or registered trademarks of Hyundai Motor Company, Korea, valid in the European Union and/or other jurisdictions. Hyundai's graphics, logos, page headers, button icons, scripts and service names are trademarks or trade dress of Hyundai. Hyundai's trademarks and trade dress may not be used in association with any non-Hyundai product or service in any manner that is likely to cause confusion among customers or disparage or discredit Hyundai. All other trademarks not belonging to Hyundai Motor Company that are featured in relation to the Services and any related site belong to their respective owners, who may or may not be affiliated with, connected to, or sponsored by Hyundai. 

8. Limitation of Liability.

8.1 We endeavor to ensure the uninterrupted availability of the Services and error-free transmission. However, due to the nature of the Internet, uninterrupted and error-free access cannot be guaranteed. We will not be liable to you for the accuracy and timeliness of the data and information transmitted via the Services.

8.2 We will not be liable to you for the consequences of disruption, interruptions and functional impairments of the Services and any suspension and/or restriction of the access to the Services as set out in section 6.3.

8.3 We are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable.

8.4 We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, representatives or subcontractors or for fraud or fraudulent misrepresentation.

8.5 We are not liable for business losses. The Services are for private use. If you use the Services for any commercial, business or resale purpose, we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

8.6 We are not responsible for reviewing, evaluating or validating the products, services or applications of Third Party Providers and/or Hyundai Dealers. We do not assume liability for the offers of the Third Party Providers and/or Hyundai Dealers and are not responsible in any way for the actions of the Third Party Providers and/or Hyundai Dealers and/or the content, quality and/or performance of their products, services or applications. 

9. Miscellaneous.

9.1 Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

9.2 These Terms are governed by the laws [COUNTRY OF NSC]. Any potential dispute will be resolved by the courts of [SEAT OF NSC].
